प्रोत्साहन : युवा अधिवक्ताओं को : प्रतिमाह ५ हजार रुपए देने की सरकारी पहल ?

पटना : युवा अधिवकाओं के लिए एक सुखद बात है। बिहार सरकार ने युवा अधिवक्ता को प्रोत्साहित करने के लिए एक अत्यंत महत्वपूर्ण निर्णय लिया है। यह उठाया हुआ कदम अत्यंत प्रशंसनीय समझा जा सकता है। इसे प्रोत्साहन समझा जा सकता है। समझा जा सकता है कि अधिक से अधिक युवा इसमें भागीदारी करें। 
दरअसल १  जनवरी २०२४  से राज्य में नामांकित हुए सभी नए वकीलों को ३ सालों तक हर महीने ५००० का स्टाइपेंड देने का बिहार सरकार ने ऐलान किया है. न्यायिक समाचार बिहार के महाधिवक्ता और बिहार अधिक कल्याण न्यास  समिति के चेयरमैन पीके शाही ने कहा है कि सरकारी आदेश के आलोक में युवा अधिवक्ताओं को प्रतिमाह ५ हजार रुपए देने की प्रक्रिया प्रारंभ कर दी गई है। युवा अधिवक्ता में  इस समाचार को लेकर जबरदस्त उत्साह है। हालाँकि क्रियान्वन अभी वाकी है, समय साक्षी होगा। 
उन्होंने कहा कि मेरा प्रयास होगा कि १  जनवरी २०२४  को या उसके बाद बिहार बार काउंसिल से पंजीकृत हुए युवा अधिवक्ताओं को अगले दो महीने के भीतर स्टाइपेंड का लाभ प्राप्त हो जाए। अधिवक्ता संघों के माध्यम से आवेदन प्राप्तकर युवा अधिवक्ताओं का चयन किया जाएगा। उसके बाद स्टाइपेंड की राशि का भुगतान न्यास समिति के माध्यम से होगा। 
शाही ने बताया कि न्यूनतम २२  और अधिकतम ३० वर्ष तकं के युवा अधिवक्ता ही स्टाइपेंड पाने के पात्र होंगे। इस बारे में आवश्यक दिशा-निर्देश जारी किए जा रहे हैं। 
उन्होंने कहा कि अधिवक्ता कल्याण को लेकर राज्य सरकार ने जो आदेश जारी किया है, उसका पालन न्यास समिति निर्धारित समय सीमा के भीतर सुनिश्चित कराएगी। 
उल्लेखनीय है कि विधि विभाग द्वारा जारी नोटिफिकेशन में न्यास समिति को ही सम्पूर्ण कार्य के लिए अधिकृत किया गया है । इसमें बिहार बार काउन्सिल की कोई भूमिका नहीं होगी।

Vidhik Seva Pradhikaran (Legal Services Authority) is a system established under the Legal Services Authorities Act, 1987 to provide free and competent legal aid to the vulnerable sections of society.

It is a hierarchical organization, with a national-level body (NALSA), state-level authorities (SLSA), and district-level authorities (DLSA). Key functions include providing legal advice, representing people in court, and organizing Lok Adalats (public courts) for the speedy and amicable resolution of disputes.

These are the Key functions of

Legal Aid and Advice : Offers free legal aid and advice to eligible individuals and also provides legal representation in court and other tribunals.
Lok Adalats: Organizes regular Lok Adalats to settle pending cases and pre-litigation matters through mutual agreement, aiming for speedy justice.
Pre-Litigation Dispute Resolution: Establishes permanent Lok Adalats for pre-litigation dispute resolution, particularly in cases related to public utility services.
Legal Awareness : Conducts legal awareness programs to educate the public, especially marginalized communities, about their legal rights and government schemes.
Assistance to Specific Groups : Provides free legal aid to undertrial prisoners and organizes legal literacy classes for women, children, and others.
Financial and Grant Distribution : The national body provides funds and grants to state authorities and NGOs to help them execute legal aid initiatives.

The Bar Council of India (BCI) Advocates Welfare Fund is a fund established to provide financial assistance and social security to advocates, particularly during times of need like serious illness, death, or permanent disability. It is also used for other benefits such as medical and educational facilities for members and their dependents, purchasing books, and maintaining common facilities for advocates. The fund is supported by contributions from state Bar Councils, the BCI, voluntary donations, and other sources like government grants.
Purpose and benefits : these are the benefits of funds
Financial Assistance : Provides grants for serious health problems, a fixed amount upon cessation of practice, or to the nominee/heir in case of a member's death.

AIBE : All India Bar Examination : Passing Exams : Must or Not :

These are the findings of the these questions as I get and observe .
Yes, passing the All India Bar Examination ( AIBE ) is mandatory for all law graduates who want to practice law in India. This exam is conducted by the Bar Council of India and is required to get a "Certificate of Practice," which is necessary to practice in any court in India.
For aspiring lawyers : If you plan to work as a lawyer in an Indian court, you must enroll with a State Bar Council and then pass the AIBE to receive your Certificate of Practice.
For law graduates not practicing : If you do not intend to practice law, you are still required to enroll with the State Bar Council, but you are not obligated to take the AIBE.
Important note : Passing the AIBE is a requirement for all law graduates from the 2009-2010 academic year onwards.
Graduate whose academic session is prior to 2009-2010 they need not face AIBE Exams. They can do the practice without it.
It is clearly mentioned and verified by all legal authorities that the graduates who passed after 2009-2010 they need a COP ( Certificate of Practice ) necessarily to do the legal practice in any court of India.

When you apply and after getting police verification  your claims are considered to be right.
You are given enrollment number. Now you become the payee. You pay the fixed amount worth 6000/ - rs in Bar Council Associated Bank.
You mention the enrollment number and center of practice over the counter part  of   Challan 
You get the Bar Council of India Advocates Welfare Fund Receipt
Then lastly you get the Certificate of Admission as an Advocate, under Advocates Act 1961. 
Altogether it takes 6 to 7 months

Answer : There has been always a question strikes in my mind that 
is it necessary for a lawyer to enroll himself in any District Bar Association ?Answer is in yes.Until and unless you get your enrollment you are not authorised to get your experience certificate. So for that reason you need an enrollment anywhere in District Bar Association.As soon as you get enrolled in the State Bar Council you are entitled to be an advocate.

a. For the term of getting experience : that is issued by a District Bar Association that is needed in various types of posts 

b. Signing Vakalatnama it is necessary to get enrolled in any District Bar Association. 
A vakalatnama is a legal document in which a client authorizes an advocate to act on their behalf in a court case. It functions as a power of attorney for legal proceedings, granting the lawyer the authority to represent the client, file documents, make arguments, and take other necessary actions. The document is signed by the client and accepted by the advocate(s) and is also referred to as a memo of appearance or Vakil Patra
